Ministry of Commerce: Impose anti-dumping duties on imports of m-phenoxybenzaldehyde from India
On June 8, 2017, the Ministry of Commerce (hereinafter referred to as the investigating authority) issued Announcement No. 29 of 2017, deciding to carry out an anti-dumping investigation on the imported m-phenoxybenzaldehyde (hereinafter referred to as the investigated product) originating in India. The investigating authority finally ruled that during the investigation period of this case, the imported m-phenoxybenzaldehyde originating in India was dumped, and the domestic m-phenoxybenzaldehyde industry was materially damaged, and there was a causal relationship between dumping and material damage.
The announcement shows that from June 8, 2018, when importing m-phenoxybenzaldehyde originating in India, import operators should pay corresponding anti-dumping duties to the customs of the People's Republic of China. Anti-dumping duty shall be levied ad valorem on the customs value approved by the customs. The calculation formula is: anti-dumping duty=customs value × Anti-dumping duty rate. The import value-added tax shall be levied ad valorem at the dutiable price approved by the customs, plus customs duties and anti-dumping duties.
According to the announcement, the margin provided by the relevant import operators to the Customs of the People's Republic of China in accordance with the preliminary determination announcement from February 8, 2018 to June 7, 2018 will be collected and converted into anti-dumping duties according to the scope of goods and the rate of anti-dumping duties determined by the final determination, and the import value-added tax will be collected according to the corresponding value-added tax rate. During this period, the part of the deposit provided by the relevant import operator that exceeds the anti-dumping duty and the import value-added tax that is overcharged will be refunded by the customs, and the part that is overcharged will not be levied. Anti-dumping duties shall not be retroactively levied on imported m-phenoxybenzaldehyde originating in India before the date of the implementation of the provisional anti-dumping measures.
